Criminal Enforcement Thresholds for Counterfeiting in China
According to an article in Managing Intellectual Property, "The thresholds set in existing police guidelines (which do not have the force of law) are high. Prosecutors can only bring criminal cases against counterfeiting companies that have received more than Rmb 500,000 ($60,400) in illegal income from their infringing activities. Valuation thresholds are usually (but not always) calculated by reference to the market value of the fake good and not the real thing, meaning investigators have to find a lot of Rmb 2 fake DVDs before they can bring a criminal action."
