Parallel UK Revocation/EPO Opposition Proceedings Move Forward
According to the IP Kat reporting on Glaxo Group Ltd v Genentech Inc and Biogen Idec Inc. [2008] EWCA Civ 23, the UK Court of Appeal confirmed the Patent Court’s decision to permit a British national invalidity proceeding to go forward without suspension, despite the existence of a parallel opposition proceeding at the EPO. "The IPKat deeply regrets the almost ridiculously lengthy period of time that the EPO can take to resolve revocation issues, given the relatively short maximum life-span of most patents."
