Tips for Using the CREATE Act

• Include a portion of the Joint Reserach Agreement that can be used as an excerpt of the whole Agreement for recordation purposes at the Patent Office.
• Include a broadly-worded field of research
• Don't invoke the Act too early
• Match the field of invention in patent applications to the field of research in the Agreement
• Record an excerpt of the Agreement, not the entire Agreement
• Consider the consequences of a terminal disclaimer before invoking the Act
